The Federal Supreme Court did not enter into the appellant's appeal against the Bern Appellationshof decision in an eviction matter because he failed to pay the ordered cost advance even within the extended deadline. Invoking Art. 62(3) and Art. 108(1)(a) BGG, the President issued a non-entry decision. In view of the circumstances, the court waived the collection of court costs under Art. 66(1) second sentence BGG.
Art. 62 Abs. 3 BGG; Art. 108 Abs. 1 lit. a BGG; non-payment of the ordered cost advance after expiry of the additional time limit leads to non-entry into the appeal. If the advance is not paid despite a grace period, the court may decide in summary proceedings without examining the merits. Art. 66 Abs. 1 second sentence BGG permits waiver of court costs in the circumstances of the case.

dass unter den gegebenen Umständen auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 zweiter Satz BGG);
erkennt die Präsidentin:

Auf die Beschwerde wird nicht eingetreten.

Es werden keine Gerichtskosten erhoben.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Bern, Appellationshof, 2. Zivilkammer, schriftlich mitgeteilt.
