The appellant withdrew its appeal against a judgment of the Zurich Commercial Court after the parties reached an out-of-court settlement. The Federal Supreme Court therefore struck the case off the docket under Art. 32(2) BGG. It ordered court costs of CHF 500 against the appellant and, in line with the parties' waiver, awarded no party compensation.
Art. 32 Abs. 2 BGG; withdrawal of the appeal and discontinuance of the proceedings. Where the appellant withdraws the appeal, the Federal Supreme Court strikes the case off the docket without examining the merits. dass die Beschwerdeführerin das Urteil des Handelsgerichts des Kantons Zürich vom 12. Dezember 2013 mit Rechtsschrift vom 3. Februar 2014 beim Bundesgericht anfocht;
dass die Beschwerdeführerin mit Schreiben vom 11. April 2014 unter Hinweis auf einen zwischen den Parteien aussergerichtlich geschlossenen Vergleich mitteilte, dass sie die Beschwerde zurückziehe, die Kosten des bundesgerichtlichen Verfahrens übernehme und die Parteien gegenseitig auf Prozessentschädigungen für das bundesgerichtliche Verfahren verzichteten;
dass das bundesgerichtliche Verfahren damit in Anwendung von Art. 32 Abs. 2 BGG abgeschrieben werden kann;
dass die Gerichtskosten der Beschwerdeführerin aufzuerlegen und keine Parteientschädigungen zuzusprechen sind;
Das Verfahren wird infolge Rückzugs der Beschwerde abgeschrieben.
Die Gerichtskosten von Fr. 500.-- werden der Beschwerdeführerin auferlegt.
Es werden keine Parteientschädigungen zugesprochen.
Diese Verfügung wird den Parteien und dem Handelsgericht des Kantons Zürich schriftlich mitgeteilt.
