The Federal Supreme Court dealt with a tenant’s challenge to an eviction order concerning an apartment and parking space. It held that an ordinary civil appeal was unavailable because the dispute value requirement was not met and no fundamental legal question was raised. The submission was therefore treated as a subsidiary constitutional complaint, but it failed to engage with the cantonal court’s reasoning or identify any violated constitutional rights. The Court accordingly declined to enter into the matter, waived court costs, and refused party compensation to the respondent. The request for suspensive effect became moot.

Art. 74 Abs. 1 lit. a, Art. 74 Abs. 2 lit. a, Art. 113 ff., Art. 116, Art. 106 Abs. 2 und Art. 117 BGG; admissibility and substantiation of a subsidiary constitutional complaint. Where the value in dispute does not reach the statutory threshold and no question of fundamental importance is alleged, the ordinary civil appeal is unavailable and the filing is to be treated as a subsidiary constitutional complaint. Such a complaint may invoke only constitutional rights and must, in a reasoned manner, specifically address the considerations of the challenged decision; a mere repetition of grievances or failure to engage with the cantonal reasoning leads to non-entry under Art. 108 Abs. 1 lit. b BGG. Ancillary requests for suspensive effect become moot upon non-entry; costs may exceptionally be waived, and no party compensation is due absent reimbursable effort.

Urteil vom 2. Juli 2013

I. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Klett, Präsidentin,
Gerichtsschreiberin Schreier.

Verfahrensbeteiligte
A.________,
Beschwerdeführerin,

gegen

B.________,
Beschwerdegegner.

Gegenstand
Ausweisung,

Verfassungsbeschwerde gegen den Beschluss des Kantonsgerichts Schwyz, 2. Zivilkammer, vom 6. Mai 2013.

In Erwägung,
dass der Einzelrichter des Bezirksgerichts March die Beschwerdeführerin mit Verfügung vom 7. März 2013 anwies, die ihr vom Beschwerdegegner vermietete Wohnung an der X.________strasse in Y.________ und den dazugehörigen Autoabstellplatz bis zum 25. März 2013, 12.00 Uhr, ordnungsgemäss zu verlassen und dem Beschwerdegegner zu übergeben;
dass das Kantonsgericht Schwyz die von der Beschwerdeführerin dagegen erhobene Beschwerde und deren Gesuch um Gewährung der unentgeltlichen Rechtspflege mit Beschluss vom 6. Mai 2013 abwies;
dass die Beschwerdeführerin dem Bundesgericht mit Beschwerde vom 23. Juni 2013 beantragte, der Beschluss des Kantonsgerichts sei aufzuheben, und sie zudem um Erteilung der aufschiebenden Wirkung und Gewährung der unentgeltlichen Rechtspflege ersuchte;
dass das Bundesgericht von Amtes wegen prüft, ob ein Rechtsmittel zulässig ist (BGE 138 III 471 E. 1; 137 III 417 E. 1; 136 II 101 E. 1);
dass eine Beschwerde in Zivilsachen im vorliegenden Fall nicht zulässig ist, weil der erforderliche Streitwert von Fr. 15'000.-- (Art. 74 Abs. 1 lit. a BGG) nicht erreicht wird und die Beschwerdeführerin nicht geltend macht, es stelle sich eine Rechtsfrage von grundsätzlicher Bedeutung im Sinne vom Art. 74 Abs. 2 lit. a BGG;
dass die Eingabe der Beschwerdeführerin damit als subsidiäre Verfassungsbeschwerde im Sinne von Art. 113 ff. BGG zu behandeln ist;
dass mit einer solchen Beschwerde ausschliesslich die Verletzung von verfassungsmässigen Rechten gerügt werden kann (Art. 116 BGG);
dass in der Beschwerdeschrift dargelegt werden muss, welche verfassungsmässigen Rechte durch das kantonale Gericht verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides zu begründen sind (Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass die Eingabe vom 23. Juni 2013 diese Begründungsanforderungen offensichtlich nicht erfüllt, weil gar nicht auf die Erwägungen des angefochtenen Beschlusses eingegangen wird;
dass demnach auf die Beschwerde mangels genügender Begründung im Verfahren nach Art. 108 Abs. 1 lit. b BGG nicht einzutreten ist;
dass das Gesuch um Gewährung der aufschiebenden Wirkung mit dem Entscheid in der Sache gegenstandslos wird;
dass ausnahmsweise auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 zweiter Satz BGG), womit das Gesuch um Befreiung von diesen Kosten gegenstandslos wird;
dass der Beschwerdegegner keinen Anspruch auf eine Parteientschädigung hat, da ihm aus dem bundesgerichtlichen Verfahren kein Aufwand erwachsen ist (Art. 68 Abs. 1 BGG);

erkennt die Präsidentin:

1.

Auf die Beschwerde wird nicht eingetreten.

2.

Es werden keine Gerichtskosten erhoben.

3.

Es wird keine Parteientschädigung zugesprochen.

4.

Dieses Urteil wird den Parteien und dem Kantonsgericht Schwyz, 2. Zivilkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the federal appeal in civil matters was admissible despite the low amount in dispute.

Decisione estratta

The ordinary civil appeal was not available because the dispute value threshold was not met and no question of fundamental importance was invoked.

Motivazione estratta

The value in dispute did not reach CHF 15,000 and the appellant did not claim a legal question of fundamental importance.

Questione giuridica chiave

Whether the filing could be treated as a subsidiary constitutional complaint and met the reasoning requirements.

Decisione estratta

It was treated as a subsidiary constitutional complaint, but the pleading failed to specify and substantiate any violation of constitutional rights by reference to the cantonal decision.

Motivazione estratta

A constitutional complaint may only invoke constitutional rights, and the brief did not address the reasons of the challenged decision, so it lacked sufficient reasoning.

Questione giuridica chiave

Whether the request for suspensive effect should be granted.

Decisione estratta

The request became moot once the complaint was declared inadmissible.

Motivazione estratta

With no admissible main proceeding, the interim request no longer had an object.

Questione giuridica chiave

Whether court costs should be charged and legal aid granted for costs.

Decisione estratta

No court costs were charged, so the request for exemption from costs was moot.

Motivazione estratta

The court exceptionally waived court costs under the Federal Supreme Court Act.

Questione giuridica chiave

Whether the respondent was entitled to party compensation.

Decisione estratta

No party compensation was awarded because the respondent incurred no expense in the federal proceedings.

Motivazione estratta

Without reimbursable effort, there was no basis for an award of party costs.
