Before the Federal Court could examine the merits, his lawyer informed the court by letter of 6 May 2010 that the appeal was withdrawn. The President of the First Civil Law Court therefore ordered the case struck off the docket and set court costs at CHF 300, payable by the appellant.
Art. 32 al. 2 LTF; withdrawal of an appeal: where the appellant withdraws the appeal, the Federal Court strikes the case from the docket without examining the merits. The withdrawal terminates the proceedings; the court may allocate costs to the withdrawing appellant, here with costs fixed at CHF 300 (consid. without further reasoning).
