In an appeal against a Geneva decision on spousal maintenance in protective measures proceedings, the appellant filed a withdrawal declaration. The Federal Supreme Court took note of the withdrawal, struck the case from the docket, and ordered the appellant to bear the judicial fee of CHF 300. The order was issued in written proceedings by the presiding judge of the Second Civil Law Court.
Art. 32 al. 2 LTF; art. 73 PCF in conjunction with art. 71 LTF; withdrawal of the appeal: where the appellant withdraws the remedy, the Federal Supreme Court takes note of the withdrawal and removes the cause from the roll. Costs are allocated according to Art. 66 al. 1 LTF, ordinarily to the withdrawing appellant.
