The appellant challenged a Bern supervisory decision concerning a list of encumbrances, but withdrew the appeal by letter of 2 February 2009. The Federal Supreme Court therefore struck the proceedings off the docket as terminated by withdrawal and, applying the relevant federal procedural provisions, ordered the appellant to pay court costs of CHF 150. The order was communicated to the parties and the cantonal supervisory court.
Art. 32 Abs. 2 BGG; withdrawal of the appeal leads to discontinuance of the proceedings by the division president. In such a case, the matter is struck from the roll pursuant to the procedural rules applicable by analogy under Art. 71 BGG in conjunction with Art. 73 BZP. Costs follow the withdrawal and are ordinarily imposed on the withdrawing appellant under Art. 66 Abs. 1 BGG, with the supplementary provisions of Art. 5 Abs. 2 BZP applicable via Art. 71 BGG. The decision is rendered without examination of the merits once the withdrawal is effective.

verfügt die Präsidentin:

Das Verfahren wird als durch Rückzug der Beschwerde erledigt abgeschrieben.

Die Gerichtskosten von Fr. 150.-- werden dem Beschwerdeführer auferlegt.
