The Federal Supreme Court dismissed the civil appeal as inadmissible because the appellant submitted no reasoned challenge meeting the requirements of Art. 42(2) and 106(2) LTF, and the time for supplementation had expired. It also rejected the request for legal aid because the appeal lacked prospects of success. Court costs of CHF 500 were imposed on the appellant. The case arose from a Vaud enforcement proceeding in which the cantonal court had refused restitution of the deadline for advancing costs and had declared the cantonal appeal inadmissible.
Art. 42 al. 2, Art. 106 al. 2, Art. 108 al. 1 let. b and Art. 64 LTF; admissibility of a civil appeal and legal aid where the filing lacks motivation. A federal appeal must set out, in a reasoned manner, which rights or legal norms were violated; with respect to fundamental rights and cantonal law, the reasoning burden is stricter. If the appeal does not meet these requirements and the defect can no longer be cured after expiry of the appeal period, summary non-entry is warranted. Legal aid is granted only if the recourse is not devoid of prospects of success; an inadmissible appeal lacks such prospects. Costs are then borne by the unsuccessful appellant (consid. 1-3).

l'acte de recours du 12 octobre 2010 et la demande d'assistance judiciaire qu'il contient;
Considérant:
que l'arrêt attaqué, statuant sur recours de A.________ contre un prononcé du Juge de paix du district de La Broye-Vully dans la poursuite n° xxxx de l'Office des poursuites de Moudon-Oron exercée par B.________ SA, rejette la requête de restitution du délai d'avance de frais présentée par le prénommé dans le cadre dudit recours et déclare ce dernier irrecevable faute d'avance de frais;
que le mémoire adressé au Tribunal fédéral par A.________ ne contient aucune motivation répondant aux exigences des art. 42 al. 2 et 106 al. 2 LTF et n'est plus susceptible, le délai de l'art. 100 al. 1 LTF étant échu, d'être complété;
que le recours en matière civile ne peut donc qu'être déclaré irrecevable en procédure simplifiée (art. 108 al. 1 let. b LTF);
que la demande d'assistance judiciaire doit être rejetée faute de chances de succès du recours (art. 64 al. 1 et 3, 2ème phrase, LTF);
qu'en conséquence, les frais de la présente procédure sont mis à la charge du recourant (art. 66 al. 1 LTF);
par ces motifs, la Présidente prononce:

Le recours est irrecevable.
2.
La demande d'assistance judiciaire du recourant est rejetée.
3.
Les frais judiciaires, arrêtés à 500 fr., sont mis à la charge du recourant.
4.
Le présent arrêt est communiqué aux participants à la procédure et à la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud.
