The appellant in a divorce appeal withdrew her complaint after the Federal Supreme Court had denied legal aid for lack of prospects. The president of the civil law division therefore discontinued the proceedings and ordered the case struck from the docket. Court costs of CHF 300 were imposed on the appellant. The order was communicated to the parties and the Cantonal Court of Fribourg.
Art. 32 Abs. 2 BGG; Art. 71 BGG i.V.m. Art. 73 BZP; withdrawal of the appeal and cost consequences. When the appellant withdraws the complaint, the Federal Supreme Court may, through the division president, write the matter off as concluded; the proceedings are terminated without a merits determination. The withdrawal does not preclude an allocation of costs to the withdrawing party. Costs are imposed according to the general cost rules of the BGG and, by analogy, the procedural provisions of the BZP, where the withdrawal is the cause of the termination (consid. 1).

November 2008) mit Schreiben vom 9. Dezember 2008 zurückgezogen hat, die Beschwerde daher durch den Abteilungspräsidenten (Art. 32 Abs. 2 BGG) abzuschreiben ist (Art. 71 BGG i.V.m. Art. 73 BZP) und die Kosten der Beschwerdeführerin aufzuerlegen sind (Art. 71 BGG i.V.m. Art. 5 Abs. 2 BZP, Art. 66 Abs. 1 BGG),
verfügt der Präsident:

Das Verfahren wird als durch Rückzug der Beschwerde erledigt abgeschrieben.
2.
Die Gerichtskosten von Fr. 300.-- werden der Beschwerdeführerin auferlegt.
3.
Diese Verfügung wird den Parteien und dem Kantonsgericht Freiburg schriftlich mitgeteilt.
