The Swiss Federal Court held that the appeal against a cantonal maintenance-protection judgment was filed after the 30-day deadline. Because the case concerned precautionary measures, the suspension of time limits did not apply. The appeal was therefore manifestly inadmissible and was not entered into under the simplified procedure. The request for free legal assistance was denied as hopeless, and court costs of CHF 500 were imposed on the appellant.

Art. 100 Abs. 1, Art. 46 Abs. 2, Art. 64 Abs. 1, Art. 66 Abs. 1 and Art. 108 Abs. 1 lit. a BGG; timeliness of a federal appeal against a precautionary measure and consequences of lateness. In proceedings concerning protective measures, the statutory suspension of deadlines does not apply. An appeal filed after expiry of the 30-day deadline is manifestly inadmissible and may be disposed of without entering into the merits under Art. 108 Abs. 1 lit. a BGG. A hopeless out-of-time appeal excludes free legal assistance. The unsuccessful appellant bears the court costs.

Gegenstand
Eheschutz,

Beschwerde nach Art. 72 ff. BGG gegen das Urteil vom 13. Dezember 2012 des Obergerichts des Kantons Zug (II. Zivilabteilung).

Nach Einsicht

in Erwägung,
