The appellant challenged condominium owners' association resolutions by civil appeal. While the appeal was pending, the Federal Supreme Court upheld the parallel constitutional complaint against the same cantonal judgment and remitted the case for evidentiary proceedings and a new decision. As a result, the appeal had no remaining object and was struck out as moot. The court ordered the appellant to pay a reduced court fee of CHF 200.
Art. 156 Abs. 1 OG; when an appeal becomes moot because a parallel remedy has led to the setting aside of the challenged decision and remittal, the appeal is struck from the roll. In such a case the filing party bears a reduced court fee. Mootness extinguishes the need for a merits determination; the court confines itself to the procedural consequence and costs allocation.

Das Bundesgericht hat nach Einsicht
in die Eingabe vom 25. Oktober 2006, mit der X.________ gegen das Urteil des Obergerichts des Kantons Aargau vom 11. September 2006 Berufung eingereicht hat,
in Erwägung,
dass X.________ gegen das erwähnte Urteil auch staatsrechtliche Beschwerde eingereicht hat,
dass die erkennende Abteilung mit Urteil vom heutigen Tag diese gutgeheissen, das angefochtene Urteil aufgehoben und die Sache zur Durchführung eines Beweisverfahrens bzw. der Erstellung des rechtserheblichen Sachverhaltes und zur neuen Entscheidung an die Vorinstanz zurückgewiesen hat,
dass die Berufung dadurch gegenstandslos geworden ist,
dass bei Gegenstandslosigkeit demjenigen, der das Rechtsmittel eingereicht hat, eine reduzierte Gerichtsgebühr aufzuerlegen ist (Art. 156 Abs. 1 OG),
erkannt:

Die Berufung wird als gegenstandslos abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 200.-- wird dem Berufungskläger auferlegt.
3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau schriftlich mitgeteilt.
