The Federal Supreme Court did not enter into the appeal against the discontinuance of criminal proceedings for fraud, sexual coercion and related offences. It held that the appellant lacked standing for all allegations except sexual coercion against his former wife, and he failed to substantiate that claim in his submission. The request for free legal aid was refused because the appeal was hopeless. Court costs of CHF 500 were imposed on the appellant, with a reduced fee reflecting his financial situation.

Art. 81 Abs. 1 lit. b Ziff. 4 and 5 BGG; Art. 42 Abs. 2 BGG; standing to appeal against the discontinuance of criminal proceedings. If the cantonal public prosecutor participates, the matter is not a private prosecution within Art. 81(1)(b)(4) BGG. The injured party is entitled to appeal only insofar as he qualifies as an alleged victim within Art. 81(1)(b)(5) BGG in conjunction with the OHG. For all other offences, mere injured-party status does not confer standing (cf. BGE 133 IV 228). The appeal must also satisfy the substantiation requirement of Art. 42(2) BGG by addressing the standing-conferring ground specifically; a general reference to victim status is insufficient. Legal aid under Art. 64 BGG is denied where the appeal is manifestly without prospects of success.

Urteil vom 16. Februar 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Einstellung der Untersuchung (Betrug usw.),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 20. Dezember 2007.

Der Präsident zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the appellant had standing to challenge the discontinuance of the investigation.

Decisione estratta

Standing existed only regarding the allegation of sexual coercion against the former wife; for the remaining offences he was merely an injured party and lacked standing.

Motivazione estratta

Because the cantonal prosecution participated, the case was not a private prosecution within Art. 81(1)(b)(4) BGG. Under Art. 81(1)(b)(5) BGG in conjunction with Art. 2(1) OHG, victim standing is limited to the sexual coercion allegation. The complaint contained no specific argument on that point and therefore failed to meet Art. 42(2) BGG.

Questione giuridica chiave

Whether the complaint satisfied the federal pleading requirements.

Decisione estratta

No. The submission did not address the only potentially standing-conferring allegation with sufficient reasoning.

Motivazione estratta

A bare assertion that the appellant was a victim of his rejected ex-wife did not satisfy the substantiation requirement of Art. 42(2) BGG.

Questione giuridica chiave

Whether legal aid should be granted.

Decisione estratta

No, because the appeal had no prospect of success.

Motivazione estratta

Under Art. 64 BGG, unentgeltliche Rechtspflege is denied when the requested relief is manifestly hopeless.
