Sintesi Omnilex

The Federal Supreme Court did not enter into the appellant’s complaint against the cantonal non-prosecution decision concerning alleged bodily interference during a dispute over heating. The court held that the submission failed to confront the decisive reasoning of the Obergericht, namely the absence of alleged intent, and therefore did not satisfy the substantiation requirement of Art. 42(2) BGG. The complaint was rejected at the threshold under Art. 108 BGG. Court costs of CHF 800 were charged to the appellant; no compensation was awarded to the respondent.

Massima Omnilex

Art. 42 Abs. 2 BGG; Art. 108 BGG; an appeal must, in concise form, address the decisive reasoning of the challenged decision and indicate specifically how it infringes federal law. If the appellant omits to deal with the determinative grounds, the court does not enter into the matter. A mere request for a different substantive outcome, without engagement with the reasoning on which the lower court based its decision, is insufficient for admissibility (consid. 1).

Urteil vom 21. Januar 2013
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

  1. Staatsanwaltschaft des Kantons Thurgau, Staubeggstrasse 8, 8510 Frauenfeld,
  2. Y.________,
    Beschwerdegegner.

Gegenstand
Nichtanhandnahme (Tätlichkeit),

Beschwerde gegen den Entscheid des Obergerichts
des Kantons Thurgau vom 24. Oktober 2012.

Der Einzelrichter zieht in Erwägung:

1.

Questione giuridica chiave

Whether the complaint adequately challenged the cantonal court’s finding that the respondent lacked intent.

Decisione estratta

The complaint did not address the decisive reasoning on intent and therefore failed to meet the Federal Supreme Court’s pleading requirements.

Motivazione estratta

Under Art. 42(2) BGG, a complaint must briefly explain how the challenged decision violates law; because the appellant did not engage with the intent issue, the court could not examine the merits and had to refuse entry under Art. 108 BGG.

Questione giuridica chiave

Allocation of court costs and compensation

Decisione estratta

Court costs were imposed on the appellant; no compensation was awarded to the respondent because he incurred no expenses before the Federal Supreme Court.

Motivazione estratta

As the complaint was not entertained, costs followed the outcome and no party compensation was due absent compensable effort by the respondent.
