Sintesi Omnilex

The Federal Supreme Court did not enter into the complainant's challenge to the Zurich cantonal ruling on compensation and satisfaction after a discontinued criminal investigation. The submission contained no concrete request and no sufficient reasoning addressing the cantonal court's non-entry decision. The complaint therefore failed the requirements of Art. 42 BGG and was inadmissible under Art. 108 BGG. Court costs of CHF 800 were imposed on the complainant.

Massima Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 108 BGG; Art. 66 Abs. 1 BGG: An appeal to the Federal Supreme Court is inadmissible if it contains neither a substantive request nor reasons that engage with the contested decision and show, in a concise manner, in what respect federal law is allegedly violated. A merely factual recapitulation from the appellant's own perspective does not satisfy the duty of reasoning. Where the complaint is not entered into, the court costs are charged to the complainant.

Urteil vom 31. Mai 2013
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiberin Arquint Hill.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Staatsanwaltschaft Zürich-Limmat,
Postfach, 8026 Zürich,
Beschwerdegegnerin.

Gegenstand
Kosten- und Entschädigungsfolgen,

Beschwerde gegen die Verfügung des Obergerichts des Kantons Zürich, III. Strafkammer, vom 16. April 2013.

Der Einzelrichter zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the federal complaint met the reasoning requirements for admissibility under the Federal Supreme Court Act

Decisione estratta

The complaint did not satisfy the statutory reasoning requirements because it contained no substantive request and did not engage with the challenged cantonal decision.

Motivazione estratta

The submission merely repeated the complainant's own version of events and did not show, even in summary form, how the cantonal court allegedly violated federal law; therefore Art. 42(1) and (2) BGG were not met and non-entry followed under Art. 108 BGG.

Questione giuridica chiave

Who bears the court costs before the Federal Supreme Court

Decisione estratta

The court costs are imposed on the complainant.

Motivazione estratta

As the complaint was not entered into, the losing party must bear the costs under Art. 66(1) BGG.
