The Federal Supreme Court held that the appellant's challenge to a CHF 600 fine for speeding in a built-up area was purely appellatory and failed to show manifestly incorrect findings. The alleged visibility issue at the scene did not discredit the lower court's inspection-based findings, and an apparent mistake about the appellant's income was only a clerical slip without bearing on the conviction. Because no admissible grounds were raised, the Court did not enter into the complaint and imposed court costs of CHF 1,000 on the appellant.

Massima Omnilex

Art. 108 BGG; admissibility of a criminal appeal against factual findings and minor clerical errors; the Federal Supreme Court will not entertain a complaint that merely opposes the lower court's assessment with appellatory argumentation. Factual findings may only be challenged by showing manifest error or a legal violation. An obvious transcription mistake in the reasoning of the cantonal decision does not, by itself, impair the conviction where the record clearly shows the correct fact and no influence on the sentence is demonstrated. Absent a substantiated legal grievance, the appeal is inadmissible and may be disposed of summarily under Art. 108 BGG (consid. 1).

Urteil vom 12. Oktober 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Luzern, Zentralstrasse 28, 6002 Luzern.

Gegenstand
Überschreiten der signalisierten Höchstgeschwindigkeit,

Beschwerde in Strafsachen gegen das Urteil des Obergerichts des Kantons Luzern, II. Kammer, vom 23. April 2007.

Der Präsident zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Beschwerdeführer, der Staatsanwaltschaft des Kantons Luzern und dem Obergericht des Kantons Luzern, II. Kammer, schriftlich mitgeteilt.

Estratto da Omnilex

Questione giuridica chiave

Whether the appeal could succeed against the lower court's factual findings on visibility and speed measurement circumstances.

Decisione estratta

The appellant's submissions were merely appellatory and did not show that the lower court's findings were manifestly incorrect or legally flawed.

Motivazione estratta

The lower court had inspected the scene and conducted a nighttime view under comparable conditions, clearly establishing continuous visibility of vehicle taillights. The challenge did not meet the standard for correcting factual findings.

Questione giuridica chiave

Whether an apparent transcription error concerning the appellant's income undermined the conviction or sentence.

Decisione estratta

No. The income figure was an obvious clerical mistake because the record showed the amount was annual, not monthly, and it did not affect the conviction.

Motivazione estratta

A mere slip in the reasoning of the lower court does not show defects in the conviction itself.

Questione giuridica chiave

Whether alleged lack of remorse could affect the fine in a way relevant to the appeal.

Decisione estratta

The appellant did not show that this point could materially affect the CHF 600 fine.

Motivazione estratta

No concrete impact on the penalty was demonstrated.

Questione giuridica chiave

Whether the complaint was admissible under Art. 108 BGG.

Decisione estratta

The appeal was not admissible and could not be entered into under Art. 108 BGG.

Motivazione estratta

The appeal failed to raise a cognizable legal error or manifestly incorrect factual finding.
