The Federal Supreme Court did not enter into the complainants' request for recusal and did not admit the complaint against the refusal to open criminal proceedings for defamation, fraud, and extortion. It held that mere prior participation in an earlier federal case is not a recusal ground, and that the complainants were not victims under the applicable standing rules because they were not directly affected in their physical, sexual, or psychological integrity. The complaint was therefore inadmissible in summary non-entry proceedings. Court costs of CHF 1,500 were imposed on the complainants jointly and severally, each bearing half.

Art. 34 Abs. 2 BGG; Art. 81 Abs. 1 lit. b Ziff. 5 BGG; Art. 2 Abs. 2 OHG; summary non-entry under Art. 108 BGG: prior participation of a federal judge in an earlier proceeding does not, by itself, constitute a ground for disqualification. A complainant challenging the refusal to open criminal proceedings is only legitimized if directly and immediately affected in the legally protected interests required by the victim status provision; mere indirect concern or private interest is insufficient. If standing is lacking, the complaint is not admitted in the simplified procedure, and costs may be allocated under Art. 66 Abs. 1 BGG.

Urteil vom 23. September 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________, Y.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Basel-Landschaft, Bahnhofplatz 3a, 4410 Liestal, Beschwerdegegnerin.

Gegenstand

Questione giuridica chiave

Whether the request for recusal had to be entered into because of prior participation in a Federal Supreme Court case.

Decisione estratta

Prior participation in an earlier Federal Supreme Court proceeding is not, by itself, a ground for disqualification.

Motivazione estratta

Article 34(2) BGG excludes a recusal ground based solely on participation in an earlier federal case.

Questione giuridica chiave

Whether the complaint against the refusal to open criminal proceedings was admissible and whether the complainants had standing.

Decisione estratta

The complainants lacked standing because they were not directly affected in their physical, sexual, or psychological integrity and therefore were not victims within the meaning of the BGG standing provision.

Motivazione estratta

Under Article 2(2) OHG, the alleged offenses did not directly impair the complainants' protected integrity; the other standing requirements were also not met. The complaint therefore could not be examined under the summary non-entry procedure.

Questione giuridica chiave

Whether the costs of the federal proceedings should be borne by the complainants.

Decisione estratta

The court costs were imposed on the complainants jointly and severally, each for half.

Motivazione estratta

Costs follow the outcome under Article 66(1) BGG.
