The Federal Supreme Court noted that the criminal appeal had been withdrawn by letter of 25 September 2013. It therefore struck the case off the docket as moot. Despite the late withdrawal, it exceptionally waived any court costs. The order was issued by a single judge of the Criminal Division.
Withdrawal of the appeal renders the proceedings moot; the court strikes the case off the docket. Even where the withdrawal is late, costs may exceptionally be waived in the exercise of judicial discretion.
