Sintesi Omnilex

The Federal Supreme Court did not enter into the criminal appeal by X. against the Solothurn cantonal appellate decision. It held that the submission failed to meet the BGG reasoning requirements because it did not show any violation of Swiss law, and it also refused to consider a request for compensation for the appellant's son because that matter was not part of the challenged decision. The president exceptionally waived court costs, which rendered the request for exemption from an advance on costs moot.

Massima Omnilex

Art. 42 Abs. 2 und Art. 106 Abs. 2 BGG; Art. 108 BGG; requirements of reasoning for a federal appeal and non-entry. A complaint that merely criticizes a cantonal decision without addressing the application of federal law or identifying a violation of Swiss law does not satisfy the Federal Supreme Court's reasoning requirements. The Court examines only issues encompassed by the contested decision; requests falling outside its subject matter are inadmissible. Where the appeal is manifestly insufficiently reasoned, the President may decide under Art. 108 BGG. An exceptional waiver of court costs renders a request for exemption from advance payment moot.

Urteil vom 5. Februar 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin,

gegen

Staatsanwaltschaft des Kantons Solothurn, Franziskanerhof, Barfüssergasse 28, 4502 Solothurn,
Beschwerdegegnerin.

Gegenstand

Questione giuridica chiave

Whether the criminal appeal satisfied the Federal Supreme Court's reasoning requirements and was admissible.

Decisione estratta

The appeal did not address how the cantonal decision could violate Swiss law, so the statutory reasoning requirements were not met; the court would not enter into the appeal.

Motivazione estratta

The filing did not engage with the cantonal procedural law basis of the contested decision and therefore failed under Art. 42(2) and Art. 106(2) BGG. The request concerning the son's compensation could not be heard because it was outside the scope of the challenged decision.

Questione giuridica chiave

Whether court costs should be imposed for the Federal Supreme Court proceedings and whether the fee-waiver request became moot.

Decisione estratta

No court costs were charged; as a result, the request to be released from the obligation to pay an advance became moot.

Motivazione estratta

The president exceptionally dispensed with costs, which removed the practical purpose of the fee-waiver request.
