The Federal Supreme Court held that the complaint was inadmissible because the appellant did not challenge the cantonal court's decisive reason for not entering into the appeal, namely the failure to properly declare the appeal under the CPC. As the filing lacked the required reasoning, the Court did not address the merits. The request for free legal aid was refused because the appeal had no prospect of success. Court costs of CHF 500 were charged to the appellant, taking his financial situation into account.

Art. 42 Abs. 2 BGG, Art. 108 BGG; non-entry for insufficient reasoning: a federal complaint must address the decisive considerations of the challenged decision and set out in a reasoned manner why they are unlawful. Failure to engage with the cantonal court's dispositive procedural ground results in non-entry in summary procedure. A request for free legal aid under Art. 64 BGG is to be denied where the appeal lacks prospects of success; costs are allocated under Art. 66 Abs. 1 BGG, with due regard to the party's financial circumstances under Art. 65 Abs. 2 BGG.

Urteil vom 9. Oktober 2013

Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Graubünden, Sennhofstrasse 17, 7001 Chur,
Beschwerdegegnerin.

Gegenstand
Mehrfacher Betrug,
