Sintesi Omnilex

The Federal Criminal Division held that the complaint was inadmissible insofar as it targeted the first-instance judgment, because only the last cantonal decision can be challenged before the Federal Court. It further found that the appellant did not substantiate or prove the alleged health reasons for missing the appeal deadline, so summary non-entry was appropriate. The appellant was ordered to pay CHF 800 in court costs.

Art. 80 Abs. 1 BGG; Art. 108 BGG; inadmissibility of a federal complaint directed against a non-final cantonal judgment and summary non-entry for insufficient substantiation. The Federal Court may review only the last cantonal decision. A party seeking restoration of a missed deadline must substantiate and, where required, prove the excusing circumstances; bare assertions, including unsubstantiated health claims, do not suffice. If the complaint fails to engage with the decisive cantonal reasoning in a legally sufficient manner, it may be disposed of in summary procedure without entering into the merits (consid. 1).

Urteil vom 20. Dezember 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Thurgau, Staubeggstrasse 8, 8510 Frauenfeld,
Beschwerdegegnerin.

Gegenstand
Verfügung über mit Beschlag belegte Vermögenswerte usw.

Der Präsident zieht in Erwägung:

1.

Questione giuridica chiave

Whether the federal complaint against the first-instance judgment was admissible despite being directed only against the cantonal appellate decision.

Decisione estratta

The complaint was inadmissible insofar as it challenged the 24 September 2008 judgment because federal review lies only against the last cantonal decision.

Motivazione estratta

Under Art. 80(1) BGG, only the final cantonal decision may be attacked. The complaint was thus limited to the Obergericht's 30 October 2008 decision.

Questione giuridica chiave

Whether the complaint disclosed grounds to overturn the non-entry decision and restoration refusal.

Decisione estratta

The complaint was not sufficiently substantiated; the appellant merely alleged poor health without explaining or proving it.

Motivazione estratta

The cantonal court had rejected restoration because the health reasons for missing the deadline were neither substantiated nor documented. The same deficiency persisted before the Federal Court, so summary non-entry under Art. 108 BGG was warranted.

Questione giuridica chiave

Who bears the court costs.

Decisione estratta

The appellant must pay the court costs.

Motivazione estratta

As the unsuccessful party, the appellant is charged with costs under Art. 66(1) BGG.
