The applicant sought revision and reconsideration of a prior Federal Supreme Court judgment of 28 May 2008 that had upheld his conviction for attempted extortion and pornography. The Court held that the alleged new evidence could not alter the legality of the earlier judgment and therefore dismissed the revision request insofar as it was admissible. It further held that reconsideration of Federal Supreme Court judgments is not provided for by law, so that request was not entertained. Free legal aid was refused because the request was hopeless, and court costs of CHF 1,000 were charged to the applicant.

Massima Omnilex

Art. 95 BGG; revision of a Federal Supreme Court judgment based on alleged new evidence; reconsideration of Federal Supreme Court judgments is not provided for by statute. A revision request fails where the alleged new evidence is incapable of affecting the outcome or the legality of the prior judgment. A separate request for reconsideration of a Federal Supreme Court judgment is inadmissible in the absence of a legal basis. Where the application is manifestly hopeless, free legal aid under Art. 64 BGG must be refused; court costs are borne by the unsuccessful applicant under Art. 66 Abs. 1 BGG, and a reduction under Art. 65 Abs. 2 BGG is not warranted absent a basis for leniency.

Urteil vom 20. Januar 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Bundesrichter Schneider, Mathys,
Gerichtsschreiber Monn.
Parteien
X.________, Gesuchsteller,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich, Gesuchsgegnerin.

Gegenstand
Revision/Wiedererwägung des Urteils des Bundesgerichts vom 28. Mai 2008 (6B_312/2008).

Das Bundesgericht zieht in Erwägung:

1.

5.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, II. Strafkammer, schriftlich mitgeteilt.

Questione giuridica chiave

The request for revision was dismissed insofar as it was admissible, because the alleged new evidence could not change that the conviction did not violate federal law under Art. 95 BGG.

The court found it unnecessary to examine admissibility in detail, since the three alleged new pieces of evidence were incapable of affecting the legality of the prior judgment.

Questione giuridica chiave

Questione giuridica chiave

Whether free legal aid should be granted

Decisione estratta

Questione giuridica chiave

How court costs should be allocated

Decisione estratta

Court costs of CHF 1,000 were imposed on the applicant.

Motivazione estratta

As the applicant was unsuccessful, he had to bear the costs; no reduction was warranted given his manner of conducting the proceedings.
