Sintesi Omnilex

A claimant appealed a cantonal social insurance judgment to the Federal Supreme Court. The Court held that the decision had been deemed served on 2 May 2014, so the 30-day appeal period expired on 2 June 2014. Because the appeal was only postmarked on 5/6 June 2014, it was late. The Court also found the submission did not satisfy the formal requirements of Art. 42 BGG. It therefore did not enter into the appeal and waived court costs.

Art. 44, 48, 100, 108 and 66 BGG; appeal deadline and formal requirements in summary proceedings before the Federal Supreme Court; service by deemed delivery. A cantonal decision returned uncollected after postal notice is deemed served on the day fixed by Art. 44 Abs. 2 BGG. The 30-day appeal period under Art. 100 Abs. 1 BGG runs from the following day and expires accordingly; a later postmark renders the appeal late. Independently, an appeal lacking the requirements of Art. 42 Abs. 1 and 2 BGG is obviously inadmissible and may be disposed of under Art. 108 Abs. 1 lit. a and b BGG without full exchange of pleadings. Court costs may be waived under Art. 66 Abs. 1 Satz 2 BGG.

Urteil vom 7. Juli 2014

I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, als Einzelrichter,
Gerichtsschreiber Batz.

Verfahrensbeteiligte
A.________,
Beschwerdeführerin,

gegen

Gemeinde B.________,
Beschwerdegegnerin.

Gegenstand
Prozessvoraussetzung,

April 2014.

In Erwägung,

BGE 138 I 171 E. 1.4 S. 176, 136 I 65 E. 1.3.1 S. 68 und 134 II 244 E. 2.1 f. S. 245 f.),

Decisione estratta

The appeal was filed after the 30-day deadline and was therefore inadmissible.

Motivazione estratta

The cantonal judgment was deemed served on 2014-05-02 under Art. 44 BGG; the deadline began on 2014-05-03 and expired on 2014-06-02, while the appeal was only postmarked on 2014-06-05/06.

Questione giuridica chiave

Whether the appeal complied with the formal requirements of Art. 42 BGG.

Decisione estratta

The appeal clearly failed to meet the mandatory formal requirements and was independently inadmissible on that ground as well.

Motivazione estratta

The court held that the submission did not satisfy Art. 42 para. 1 and 2 BGG, so it constituted an obviously inadmissible remedy under Art. 108 BGG.
