Sintesi Omnilex

The Federal Supreme Court found the appellant's filing in an accident insurance matter manifestly insufficient under Art. 42 BGG because it contained no proper request and no substantive engagement with the cantonal court's reasoning. As the defects were obvious, the court declined to set a deadline for correction and refused to enter into the appeal in simplified procedure under Art. 108 Abs. 1 lit. b BGG. Court costs of CHF 300 were charged to the appellant.

Massima Omnilex

Art. 42 Abs. 1 and 2 BGG; non-entry for manifestly inadequate appeal submissions; an appeal must contain a clear request and a reasoned challenge to the contested decision. The appellant must address the decisive considerations of the lower court in a manner that allows the alleged violation of law to be identified. Bare assertions or unsubstantiated criticism are insufficient. If the deficiency is obvious, the court may refuse to enter without first setting a time limit for correction under Art. 108 Abs. 1 lit. b BGG (consid. 1). Costs are borne by the losing party pursuant to Art. 66 Abs. 1 BGG (consid. 2).

Urteil vom 27. August 2010
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Verfahrensbeteiligte
B.________,
Beschwerdeführer,

gegen

Schweizerische Unfallversicherungsanstalt (SUVA), Fluhmattstrasse 1, 6004 Luzern,
Beschwerdegegnerin.

Gegenstand
Unfallversicherung (Prozessvoraussetzung),

Juni 2010 betreffend Unfallversicherung,
in Erwägung,

Questione giuridica chiave

Whether the federal appeal met the formal reasoning and request requirements under Art. 42 BGG

Decisione estratta

No. The filing did not contain a legally sufficient request and did not engage concretely with the decisive reasoning of the lower court.

Motivazione estratta

An appeal must state requests and reasons, and the appellant must show specifically how the challenged decision violates law. The submission failed to do so and also did not properly contest relevant factual findings under Art. 97 BGG.

Questione giuridica chiave

Whether a grace period for correction had to be set before non-entry

Decisione estratta

No. The court entered no time limit to cure the defects and decided in simplified procedure.

Motivazione estratta

Because the appeal was manifestly deficient, the court could refuse to enter without setting a correction deadline.

Questione giuridica chiave

Allocation of court costs

Decisione estratta

Court costs were charged to the appellant.

Motivazione estratta

Costs follow the outcome of the proceedings.
