Sintesi Omnilex

The Federal Supreme Court held that the appeal in a social assistance matter was wholly inadmissible. To the extent it challenged the cantonal Department of the Interior’s decision, it was filed after the 30-day deadline. To the extent it challenged the St. Gallen Indictment Chamber’s decision, it failed to meet the federal pleading requirements. The court therefore did not enter into the appeal and waived court costs.

Art. 100 Abs. 1, Art. 42 Abs. 1 and 2, Art. 44–48, Art. 66 Abs. 1 sentence 2 BGG; inadmissibility of a federal appeal for lateness and formal defects. An appeal filed after expiry of the statutory deadline is manifestly inadmissible. Independently thereof, an appeal that does not satisfy the minimum reasoning and form requirements of Art. 42 BGG is likewise manifestly inadmissible. In such a case, the Federal Supreme Court may decline to enter into the matter in simplified procedure under Art. 108 Abs. 1 lit. a and b BGG and may waive court costs pursuant to Art. 66 Abs. 1 sentence 2 BGG (consid. 1).

Urteil vom 14. Dezember 2012
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Verfahrensbeteiligte
G.________,
Beschwerdeführer,

gegen

Politische Gemeinde Ebnat-Kappel, vertreten durch den Gemeinderat,
Hofstrasse 1, 9642 Ebnat-Kappel,
Beschwerdegegnerin.

Gegenstand
Sozialhilfe (Prozessvoraussetzung),

Oktober 2012),

in Erwägung,

BGE 138 I 171 E. 1.4 S. 176, 136 I 65 E. 1.3.1 S. 68 und 134 II 244 E. 2.1 f. S. 245 f.),
