B., represented by counsel, withdrew his public law appeal against a 29 January 2013 judgment of the Federal Administrative Court in an invalidity insurance case. The Federal Supreme Court, sitting as a single judge, therefore removed the case from the docket. It also ordered that no judicial costs be levied. The order was communicated to the parties, the Federal Administrative Court, and the Federal Office for Social Insurance.
Art. 32 al. 2, 71 LTF; Art. 73 al. 1 PCF; withdrawal of appeal: where the appellant withdraws the appeal, the Federal Supreme Court removes the cause from the docket. The procedural consequence follows ex officio; no substantive examination remains. Under Art. 66 al. 2 LTF, the court may refrain from charging judicial costs, in particular in case of withdrawal.
