Questione giuridica chiave
Whether the cantonal court had to set a new deadline to cure the insufficiently reasoned appeal under Art. 61 lit. b ATSG.
Decisione estratta
The refusal to grant a curing deadline did not violate federal law.
Motivazione estratta
A curing deadline is generally required only when a proper appeal cannot realistically be drafted without access to the file and the lawyer was retained shortly before the appeal deadline in good faith. The cantonal court could reasonably infer from the submission that counsel already had the relevant file; in any event, the appellant failed to demonstrate the contrary in the cantonal proceedings.
