L'intérêt du public à avoir affaire à un gendarme digne de la confiance placée en lui par l'autorité qu'il est censé incarner est reconnu comme largement supérieur à son intérêt privé à la levée d'une telle mesure. Ainsi, le Conseil d'Etat était fondé à estimer que le lien de confiance devant exister avec tout fonctionnaire était rompu. La suspension de son traitement ne saurait lui causer un préjudice irréparable, le Conseil d'Etat l'ayant autorisé à exercer une activité étrangère au service.
