The case concerns accident insurance consequences of a cervical whiplash injury and psychological aftereffects. The court restates that ordinary evidentiary rules also govern whiplash cases. It further clarifies the approach to impairment indemnity for psychiatric disorders: such compensation is generally excluded in banal accidents, is doubtful in ordinary accidents, and requires a full assessment of the permanence of the impairment in serious accidents.
Art. 24 al. 1 LAA; proof and impairment indemnity for whiplash-type injuries and psychiatric sequelae. The general rules on proof apply also to cervical trauma of the “whiplash” type. As regards impairment compensation for psychological disorders, entitlement must in principle be denied in the case of a banal accident; in the case of an ordinary accident, the claim is doubtful and a detailed examination of the lasting nature of the impairment is generally not called for; in the case of a serious accident, however, such an examination is always required (federal case law).

Quant au droit à une IPAI pour troubles psychiques, il doit en principe être nié dans le cas d'un accident banal; son bien-fondé est douteux dans le cas d'un accident moyen, et il ne convient en principe pas d'instruire en profondeur la question du caractère durable de l'atteinte. En cas d'accident grave, par contre, cette analyse doit toujours être faite (jurisprudence fédérale).
