A physician appealed a six-month suspension of the authorization to practise medicine imposed for repeated improper prescription of narcotics to drug addicts and non-compliance with supervisory instructions. The court held that the appeal remained admissible even though the suspension had expired, because the sanction constituted an adverse antecedent that could affect future professional prospects. On the merits, the suspension was upheld in view of the seriousness and repetition of the misconduct, the absence of genuine therapeutic indications, the risk of dependency and black-market diversion, and the prior warning for the same conduct.

LPS.126; current legal interest in administrative appeals; suspension of a medical practice authorization: an appeal remains admissible even after the contested suspension has been executed where the measure may still affect the appellant's future professional situation as an adverse antecedent. A six-month suspension is justified where the physician repeatedly issues narcotics prescriptions without genuine therapeutic indication, disregards supervisory directives, and persists in the same conduct after a prior warning; the seriousness and recurrence of the breaches, together with the risk of dependency and illicit diversion, warrant the sanction.

Questione giuridica chiave

Whether the physician still had a current legal interest in challenging the six-month suspension after it had expired during the proceedings.

Decisione estratta

Yes. The expired suspension remained an adverse antecedent that could affect the physician's future professional situation, so the appeal was still admissible.

Motivazione estratta

Although the measure had been executed, it continued to have practical legal consequences as a professional record and could weigh against the physician in later proceedings or career matters.

Questione giuridica chiave

Whether a six-month suspension of the authorization to practise medicine was justified.

Decisione estratta

Yes. The repeated and serious misconduct, including large quantities of narcotics prescribed without genuine therapeutic indications and despite prior warnings, justified the sanction.

Motivazione estratta

The court relied on the repetitive nature of the breaches, the failure to follow the medical supervisor's directives, the risk of fostering dependency and a black market, and the fact that the physician had already received an earlier warning for the same conduct.
