In a dispute concerning complementary daily indemnity insurance, the court held that the standards for assessing a medical adviser’s report are the same as in social insurance. Where the report is complete in light of the contested rights, based on thorough examinations, takes account of the insured’s complaints, is prepared with knowledge of the patient’s history, and presents a coherent medical picture, the judge need not order further evidence even under the duty to investigate ex officio.

LCA; medical adviser’s report in complementary daily-benefit insurance; evidentiary assessment and duty to investigate ex officio. For expert medical reports obtained by an insurer in employer-linked indemnity insurance, the criteria developed in social insurance apply by analogy: the report is decisive if it is complete as to the disputed issues, based on careful examinations, considers the insured person’s complaints, relies on a known anamnestic background and sets out a coherent medical reasoning. Under the ex officio investigation principle (Art. 19 LPA in conjunction with Art. 89A LPA), the court must order further evidence only where the file does not permit a useful adjudication; it need not supplement the evidence if the report is sufficiently probative.

Questione giuridica chiave

Whether the medical adviser’s report was sufficient to decide the dispute.

Decisione estratta

Yes. The report was complete, based on thorough examinations, addressed the claimant’s complaints, considered the medical history, and presented a coherent medical context.

Motivazione estratta

For an insurer’s expert acting in the context of employer-linked daily indemnity insurance, the same standards apply as for social insurance medical reports. Because the report met those standards, the judge had no need to order additional evidence despite the duty to investigate ex officio.

Questione giuridica chiave

Whether the court had to order additional evidence ex officio.

Decisione estratta

No. Additional evidence is required only when necessary to enable a useful determination of the dispute.

Motivazione estratta

Under the ex officio investigation principle invoked by the applicable procedural rules, the court must order further evidence only if the existing file does not permit a proper decision; that was not the case here.
