Résumé

Les restrictions au droit d'aliéner un immeuble prévues par la LDTR sont applicables en cas de vente aux enchères forcées, en particulier les art. 25 et 39 LDTR. En vertu du principe de la bonne foi, la vente aux enchères d'espèce ne sera cependant pas annulée, bien qu'elle n'ait pas été soumise à autorisation du DAEL. De même, il découle du principe de proportionnalité que le droit du recourant à pouvoir aliéner l'appartement ainsi acquis doit prévaloir sur les intérêts publiés protégés par la LDTR, sous peine de léser gravement la sécurité du droit. La LDTR soumet également à autorisation l'aliénation forcée d'appartements au sens de la LP. Une vente aux enchères d'appartements organisée sans qu'une autorisation au sens de l'art. 39 al. 1 LDTR n'ait été octroyée, est une mesure nulle au sens de l'art. 22 al. 1 LP. L'acquéreur ayant sollicité l'autorisation de revendre l'appartement, les motifs de sécurité du droit conduisent toutefois dans ce cas à ne pas constater la nullité de la vente aux enchères et à examiner la revente sous l'angle de la LDTR. L'autorisation est accordée en conformité avec le principe de la proportionnalité, l'appartement concerné étant de facto déjà sorti du marché des logements à louer.
