Le fait d'interdire la pose d'un panneau publicitaire sur un immeuble constituant une restriction du droit de propriété garanti par l'art. 22 ter Cst. féd., une telle restriction ne peut être admise en l'absence de base légale claire. L'art. 56 al. 3 LR s'applique exclusivement au domaine public; il n'a pas pour but de réglementer l'affichage sur le domaine privé, même si l'affiche peut être vue du domaine public. En l'espèce, la Ville de Genève ne pouvait refuser aux requérants l'autorisation de poser deux affiches sur un immeuble privé.
