The operator of the international Christmas market requested a derogation allowing the market to open every day, including Sundays, from 4 to 22 December between 11:00 and 20:00. The competent Geneva authority refused. The decision confirms that the market, like its individual stands, remains subject to the ordinary opening and closing hours under the LHFM. The authority was entitled to consider the request too broad in duration, insufficiently justified by a decisive interest, and capable of creating a precedent that would weaken the statute.
LHFM art. 7; derogations from shop-opening hours may be refused where the requested extension goes beyond the statutory scheme, is supported mainly by economic interests, and would set a precedent incompatible with the protective purpose of the act. A Christmas market, including its individual stands, is not in a fundamentally different situation from other commercial establishments merely because of its seasonal character; the authority does not abuse its discretion by preserving the ordinary closing-hours regime and avoiding a de facto erosion of the law.

L'autorité n'a pas mésusé de son pouvoir d'appréciation en refusant la requête visant à ce que le marché international de Noël puisse être ouvert tous les jours - dimanche inclus - du 4 au 22 décembre de 11 à 20 h. Sa durée dépasse celle prévue par la loi, son intérêt, principalement économique, n'est pas déterminant et son octroi représenterait un précédent risquant de vider de sa substance la loi sur les heures de fermeture des magasins. Le marché de Noël dans son ensemble et, individuellement, les stands qui le composent, sont soumis aux heures normales d'ouverture et de fermeture prévues par la LHFM. Le marché de Noël ne se trouve pas dans une situation fondamentalement différente de celle des autres commerces de la ville de Genève. L'octroi d'une dérogation aux horaires d'ouverture et de fermeture représenterait un précédent qui risquerait de devoir être appliqué dans de très nombreux cas, vidant ainsi la LHFM de sa substance.
