Aufgrund der formellen Natur des Anspruchs auf rechtliches Gehör führt seine Verletzung grundsätzlich ungeachtet der Erfolgsaussichten der Beschwerde selbst zur Aufhebung des angefochtenen Entscheids (BGE 121 III 334 E. 3 c; 115 Ia 10; Müller Georg, Kommentar zur Bundesverfassung, N 100 zu Art. 4 BV). Die Gerichtspraxis und ein Teil der Lehre erachtet den Mangel des rechtlichen Gehörs jedoch als heilbar, wenn der Verletzte seine Mitwirkungsrechte vor einer Rechtsmittelinstanz mit vollumfänglicher Kognition nachholen kann (BGE 118 Ib 120 f. E. 4b; Studer/Rüegg/Eiholzer, Der Luzerner Zivilprozess., N 3 zu § 61 ZPO). Der Mangel kann vorliegend, da das Obergericht im Beschwerdeverfahren mit eingeschränkter Kognition urteilt, nicht geheilt werden. Trotzdem führt dies nicht notwendigerweise zur Rückweisung der Sache an die Vorinstanz. Ein an sich kassationswürdiger Entscheid wird dann nicht aufgehoben, wenn mit einer Ersatzbegründung der Beschwerdeinstanz das angefochtene Ergebnis im Gesamten vertretbar erscheint (Studer/Rüegg/Eiholzer, a.a.O., N 1 zu § 272 ZPO).

Die Vorinstanz stellte fest, der Pachtvertrag sei mindestens in zwei Vertragspunkten verletzt worden. Unbestritten ist, dass jede einzelne Vertragsverletzung eine Konventionalstrafe nach sich zieht. Sollte sich herausstellen, dass eine weitere Vertragsverletzung nachgewiesen ist und die entsprechende Begründung des vorinstanzlichen Urteils standhält, bleibt kein Raum für eine Rückweisung. (...)

Der Beklagten ist zwar ein Teilerfolg beschieden, indem festgestellt wird, dass die Vorinstanz den Nichtigkeitsgrund von § 266 lit. b ZPO verwirklicht hat. Nachdem dieser Umstand jedoch nicht zu einer vom Urteil der Vorinstanz abweichenden Entscheidung führt, sind der Beklagten dennoch sämtliche Kosten des Beschwerdeverfahrens aufzuerlegen. Immerhin rechtfertigt die Verletzung des Anspruchs auf rechtliches Gehör eine reduzierte Gerichtsgebühr.
