Aus den Erwägungen:

Wenn auch den Parteien Gelegenheit gegeben wird, gegen die Ernennung bestimmter Personen als Sachverständige Einwendungen zu erheben, so ist das Gericht, sofern nicht gesetzliche Ausstands- oder Ablehnungsgründe vorliegen, nicht gehalten, die Einwendungen nur einer Partei zu berücksichtigen. Ob ein Sachverständiger über die erforderliche Sachkunde verfügt, ist lediglich eine Frage der Beweiswürdigung (vgl. Max. XII Nr. 17 mit Hinweisen) und der Richter ist in diesen Fall bei der Auswahl des Experten frei.
