Entsprechend den §§ 123 Abs. 1 ZPO und 271 StPO können vom Kläger, Widerkläger und Privatkläger Kostenvorschüsse einverlangt werden. Bei den luzernischen Gemeinwesen im Sinne von § 1 VRG ist indessen ab sofort auf die Einholung eines Kostenvorschusses (ausgenommen für Expertisenkosten) zu verzichten. Nach Abschluss des Verfahrens ist diesen Gemeinwesen - wie dies in den Rechtsöffnungsverfahren bereits üblich ist - aber Rechnung zu stellen. Sofern die Gemeinwesen obsiegen, haben sie dann gegenüber der Gegenpartei entsprechend § 18 KoG Anspruch auf Ersatz dieser Kosten.
