Der Amtsgerichtspräsident entschied in einem Befehlsverfahren u.a.: Der Zweitbeklagten wird ab sofort verboten, die in Dispositiv Ziff. 1 vorstehend genannten Räumlichkeiten zu anderen als Wohnzwecken zu gebrauchen, insbesondere dort ein Bordell oder andere Arten der Prostitution zu dulden oder selbst zu betreiben. Im Rekursverfahren wurde dazu folgendes ausgeführt:

Unbehelflich ist aber auch, wenn die Zweitbeklagte die übermässigen Immissionen tatsächlicher und ideeller Natur eines Bordells oder eines bordellähnlichen Betriebes auf die unmittelbare Nachbarschaft, wie sie innerhalb eines Mehrfamilienhauses schon zwischen den einzelnen Wohnungen besteht, in Abrede stellen will. Die Bejahung solcher übermässig störender Immissionen ist nicht - wie die Zweitbeklagte meint - eine Frage von "irgendwelchen Lehrmeinungen", sondern das Ergebnis allgemeiner Lebenserfahrung, der sich auch das Obergericht nicht verschliesst.
