Sintesi Omnilex

The applicant wanted to extend an existing holiday home by about one third of its volume. The Regierungsrat held that such an extension cannot be regarded as a site-specific building under Art. 7(2) VV zum BMR. Because holiday homes are expressly non-site-specific and the applicant was not urgently dependent on the extension, the request was rejected.

Massima Omnilex

Art. 7 Abs. 2 VV zum BMR; site-specific building status of extensions to holiday homes. Holiday homes are expressly excluded from the category of site-specific buildings. Consequently, substantial alterations or extensions of an existing holiday home cannot as a rule be qualified as site-specific either. The recreational purpose of such a building may be fulfilled without the extension; an asserted interest in enlargement does not constitute a particularly protected need (consid. 1). Restrictive application of the ordinance is justified for conversions and extensions of existing holiday homes, since the implementing ordinance itself classifies holiday homes as non-site-specific buildings.

Entscheidpublikation VVGE 1971/75 Nr. 60, S. 64:

Questione giuridica chiave

Whether the planned extension of an existing holiday home qualifies as a site-specific building under Art. 7(2) of the implementing ordinance to the federal building decree (VV zum BMR).

Decisione estratta

No. The extension of a holiday home is not to be treated as a site-specific building, and substantial extensions of such homes generally cannot be classified as site-specific either.

Motivazione estratta

Holiday homes are expressly designated as non-site-specific buildings under Art. 7(2) VV zum BMR. If the holiday home itself is not site-specific, significant alterations or extensions to it also do not normally become site-specific. The applicant was not urgently dependent on the extension, and the holiday home could fulfill its recreational purpose without it.
