Sintesi Omnilex

The court states that the first instance was properly conducted by the single judge of the Kreisgericht under Art. 295 ZPO and Art. 6 EG ZPO. It further holds that no conciliation hearing was required because the action is one concerning personal status within Art. 198 lit. b ZPO, and this also covers the maintenance claim linked to paternity. The appellate authority is the II. Civil Chamber of the Cantonal Court under Art. 16 EG ZPO. The decision is not yet final.

Art. 198 lit. b ZPO) handelt, wozu sachgerecht auch die mit der Vaterschaft verbundene Unterhaltsklage gehört (OGer BE, 7.
