Gerügt wurde die Kürzung der Kostennote, d.h. die Höhe der zugesprochenen Entschädigung. Die Strafkammer tritt auf den Rekurs nicht ein. * Aus den Erwägungen:* Ein Beschuldigter kann nie beschwert sein, wenn das Honorar des amtlichen Verteidigers zu tief angesetzt worden ist, einerseits, weil er durch das Gesetz (§ 12 Abs. 3 der Strafprozessordnung, StPO, BGS 321.1) vor zusätzlichen Forderungen seines Anwalts geschützt ist und anderseits, weil er unter Umständen sogar durch die (zu) tiefe Kos­tennote begünstigt ist, nämlich wenn nicht auf eine Rückforderung verzichtet wird (§ 35 Abs. 1 StPO). Rechtsanwalt R. hätte in eigenem Namen Rekurs erheben müssen, da nur er im vorliegenden Fall betreffend Kostennote zur Rekurserhebung legitimiert war (vgl. auch Urteil der Zivilkammer des Obergerichts vom 7. November 2007 sowie SOG 1990 Nr. 18; BGE 110 V 360 E. 2 S. 363; Urteil des Eidg. Versicherungsgerichts U 63/04 vom 3.
