An diese Voraussetzung sind strenge Anforderungen zu stellen. Die angefochtene Verfügung stützt sich auf die gewohnheitsrechtliche Kompetenz des Oberamtmannes zur Exmission von Mietern und Pächtern. Nach der entsprechenden jahrzehntelangen Praxis darf aber der Oberamtmann die Exmission nur dann anordnen, wenn die Verhältnisse ganz klar sind, d. h. wenn ohne weiteres feststeht, dass das Miet- oder Pachtverhältnis aufgelöst ist (RB 1962 Nr. 40; 1972 Nr. 45).Betreffend Klarheit der Verhältnisse sind strenge Anforderungen zu stellen: Dem Oberamtmann als Verwaltungsbeamten kann es nicht zukommen, in einem Zuge strittige zivilrechtliche Verhältnisse zu entscheiden und die Exekution dieses Entscheides durchzuführen. Nur wo die Verhältnisse wirklich ohne weiteres vollständig klar sind, darf die bereits in die Exekution hineingreifende gewohnheitsrechtliche Exmission angeordnet werden. Besteht nur die geringste Unklarheit, hat der Oberamtmann den Gesuchsteller an den Zivilrichter zu verweisen. Die Zivilprozessordnung stellt ja dem Eigentümer in § 255 lit. c ein rasches und einfaches Verfahren zur Verfügung, wenn er geltend machen will, dass jemand ohne Rechtsanspruch sein Eigentum besetzt halte und wegzuweisen sei. Ein entsprechender Entscheid des Zivilrichters ist dann vom Oberamtmann im (normalen) Vollstreckungsverfahren ohne weiteres zu vollstrecken. * Verwaltungsgericht, Urteil vom 18. Mai 1981*
