The Zivilkammer of the Obergericht dealt with a husband’s nullity complaint in a maintenance case. The complaint attacked the assumption of a hypothetical income and a hypothetical rent when calculating support. Das tut der Ehemann nicht. Er macht lediglich unrichtige Rechtsanwendung (§ 305 Abs. 1 lit. c ZPO) geltend. Verletzt sei Art. 163 ZGB. Gestützt auf diese Bestimmung sei auch im Massnahmeverfahren die von den Parteien während des Zusammenlebens gehandhabte Aufgabenteilung massgebend. Folglich sei auch künftig von seinem aktuellen Einkommen von Fr. 3'080.- auszugehen. Weil er sich derzeit in seiner Wohnsituation besonders einschränke, müsse ihm weiter ein hypotheitischer Mietzins von Fr. 800.- zugebilligt werden*. Die Frage, ob die Aufrechnung eines hypothetischen Einkommens der Bestimmung von Art. 163 ZGB widerspricht, ist eine Rechtsfrage und nachfolgend zu untersuchen. Ob dessen Höhe von der Vorderrichterin zutreffend festgestellt wurde, ist dagegen eine solche des Sachverhaltes und kann im vorliegenden Verfahren - da nicht rechtsgenüglich angefochten - nicht überprüft werden. Dasselbe gilt für die ebenfalls beanstandeten Wohnkosten. Nur die Grundsatzfrage, ob ein hypothetischer Mietzins aufgerechnet werden muss, ist rechtlicher Natur.
