The Ticino Pretura penale noted the withdrawal of an objection against a penal decree. It struck the proceedings from the docket, declared the decree enforceable, waived the justice fee, and charged CHF 30 in decision-related costs to the objector.
Art. 210-211 CPP; withdrawal of an objection against a penal decree leads to strike-out of the objection proceedings and enforceability of the decree. Upon such withdrawal, the court may remove the case from the roll and allocate the procedural costs to the objector, while waiving the justice fee if appropriate.
