The defendant opposed a summary penalty order for a serious traffic offence. Before the hearing could take place, the accused died. The Pretura penale therefore struck the criminal proceedings from the docket, cancelled the scheduled hearing, and ordered that no fees or costs be taken.
Death of the accused; pending criminal proceedings must be removed from the docket and any scheduled hearing cancelled. In such a procedural situation, no court fees or costs are levied, the case becoming devoid of object before any merits determination can be made.
