The accused withdrew his objection to a decree of accusation. The Pretura penale therefore struck the proceeding from the docket, declared the decree enforceable, canceled the already scheduled public hearing, and returned the file to the public prosecutor. The court ordered that no fees or costs be charged for the decision. The matter was decided by single judge Marco Ambrosini of the Pretura penale in Bellinzona.
Art. 210-211 CPP; withdrawal of objection to a decree of accusation: upon valid withdrawal, the objection proceedings are terminated, the case is struck from the docket, and the decree of accusation acquires enforceability. Any already scheduled public hearing falls away. In the absence of an express cost order, no fees or expenses are levied for the decision if the court so orders.
