The defendant had filed an opposition against a summary penalty order, but withdrew it at the hearing before the Bellinzona criminal court. The judge therefore struck the proceeding from the roll and declared the summary penalty order enforceable. The court also decided that no fees or costs would be levied for this decision.
Art. 210–211 CPP; withdrawal of opposition to a summary penalty order: if the opposition is withdrawn at the hearing, the criminal proceedings are struck from the roll and the summary penalty order becomes enforceable. The court may, in the same order, waive the levy of fees and costs where so stated in the dispositive.
