The Pretura penale in Bellinzona recorded the withdrawal of the objection to a 2000 penalty order by the accused, represented by counsel. On 19 February 2003, Judge Marco Ambrosini ordered the case struck from the docket, with the penalty order becoming enforceable and the file returned to the public prosecutor for further competence. No justice fee was charged, but CHF 30 in procedural costs were imposed on the objector.
Arts. 210-211 CPP; withdrawal of opposition to a penalty order: once the objection is withdrawn, the criminal proceedings are struck from the docket and the penalty order attains enforceability. The court may, in the decree of discontinuance, allocate the procedural costs to the objecting party; a waiver of justice fee does not preclude charging stated expenses (consid. 1-2).
