The Pretura penale, through Judge Marco Ambrosini, dealt with an objection to a decree of accusation. After a settlement in which the accused apologized and undertook to pay CHF 500 to a charity, the complainant withdrew the complaint. The court struck the case from the roll and remitted the file to the public prosecutor for anything still within his competence. No court fees or expenses were charged.
Art. 31 cpv. 1, 177, 180 CP; withdrawal of the complaint following an out-of-court settlement: where the injured party validly withdraws the complaint in relation to the conduct covered by the decree of accusation, the criminal proceedings are to be discontinued and struck from the roll. In such a procedural situation, the court may also decide that no costs or fees be levied (consid. implicit).
