The Pretura penale in Bellinzona noted the accused’s withdrawal of the opposition to a penalty order. Applying Art. 210 cpv. 3 CPPT, it struck the proceedings from the docket, declared the penalty order enforceable, cancelled the already scheduled public hearing, and ordered that no taxes or costs be charged. The file was returned to the public prosecutor for any further action within his competence.
Art. 210 cpv. 3 CPPT; withdrawal of opposition to a penalty order; strike-off and enforceability. Upon withdrawal of a valid opposition, the criminal proceedings are terminated by strike-off from the docket and the penalty order becomes enforceable. Any hearing fixed for the opposition proceedings becomes moot and must not be held. The court may likewise order that no court fees or costs be levied, as expressly provided in the dispositive; consid. 1-3.
