The President of the Pretura penale in Bellinzona dealt with a withdrawn objection against a criminal decree of accusation. After taking note of the withdrawal, the court struck the proceedings from the roll and declared the decree enforceable. No justice fee was levied, but the costs of the decision, amounting to CHF 30, were imposed on the objector. The decision was rendered by President Marco Kraushaar.
Art. 210-211 CPP; withdrawal of opposition to a decree of accusation: upon valid withdrawal, the objection proceedings are terminated and struck off the roll, with the decree of accusation becoming enforceable. Costs may be charged to the objecting party notwithstanding the waiver of a court fee; the court may allocate the expenses of the decision to the objector (consid. 1-2).
