Art. 31 cpv. 1 CP; withdrawal of a complaint in a prosecution dependent on a complaint leads to discontinuance of the proceedings. Once the complainant validly withdraws the complaint, the criminal basis for continuing the case falls away and the court may strike the matter from the docket. Where the order so provides, no court fees or costs are charged.
